Two House Committees Advance Crypto Bills After Clarity Act Stalls in Senate

Two House committees advanced separate bills on September 16, 2026, to establish a Strategic Bitcoin (BTC) Reserve and revise federal tax rules for digital assets.  

The committee vote came a day after the Digital Asset Market Clarity Act failed to advance in the Senate following a 49-50 cloture vote on September 15.

The Clarity Act is a proposed U.S. federal bill designed to establish a digital asset market structure framework. It aims to set clear jurisdictional lines between federal watchdogs, assigning digital commodities to the Commodity Futures Trading Commission (CFTC) and digital securities to the Securities and Exchange Commission (SEC).

House Panel Advances Bitcoin Reserve Bill

After the Clarity Act failed to advance in the U.S. Senate, House Financial Services Chairman French Hill and House Agriculture Chairman Glenn Thompson said that Congress still needs to set rules for the crypto industry.

The House Financial Services Committee voted 28-21 to advance H.R. 8957, the American Reserve Modernization Act of 2026. Republican Rep. Nick Begich of Alaska introduced the bill in May alongside Democratic co-lead Rep. Jared Golden of Maine.

The bill aims to establish a Strategic Bitcoin Reserve within the Treasury Department to place federally forfeited Bitcoin in reserve and hold it for at least 20 years. It would also create a separate Digital Asset Stockpile to cover other digital assets.  

“We cannot allow Bitcoin to be held by the federal government to languish in fragmented and inconsistent custody. It poses unacceptable, unacceptable cybersecurity risks and fails to give an adequate accounting of what the federal government actually owns. This bill addresses these issues head-on. It directs the Treasury Department to centralize the custody of all Bitcoin and other digital assets seized through the final criminal and civil forfeiture,” Representative Bryan Steil said.

Arkham Intelligence data tracked 324,527 BTC in wallets it identified as belonging to the U.S. government as of September 17, 2026, worth about $24.8 billion.

House Panel Advances Crypto Tax Legislation

The House Ways and Means Committee voted 38-5 to advance H.R. 10357, the Digital Asset Tax Certainty Act. Chairman Jason Smith introduced the bill on September 14.

The bill would extend wash-sale rules to digital assets and clarify the tax treatment of mining and staking income.

“This legislation would be the first-ever federal law to address the substantive tax treatment of cryptocurrencies and other digital assets – affecting the one in four Americans that currently hold some form of cryptocurrency, more than 67 million people. This is a historic step that has tremendous economic and innovative potential for our nation,” Chairman Smith stated.

Each bill still needs to pass the full House and Senate before reaching the president for a signature, with the 119th Congress set to end in January 2027.
